What You Need to Know

The IRS has just released critical guidance (Notice 2025-15) regarding Form 1095 distribution requirements that requires your immediate attention if you don’t intend to distribute Form 1095 to your employees.

As part of the Paperwork Burden Reduction Act, employers now have a new option for the 2024 reporting year:

  • Instead of distributing Form 1095s to all employees, you can simply post a notice of availability
  • This notice must be posted by March 3, 2025
  • Forms are then only provided upon request

Key Deadlines

  • March 3, 2025: Deadline to either post notice of availability OR distribute all Form 1095s
  • March 31, 2025: Deadline to electronically submit Form 1094 and all Form 1095s to the IRS
  • Penalties: Up to $330 per form for incomplete, inaccurate, or late submissions
